HydraMed is not a "covered entity" under the Health Insurance Portability and Accountability Act (HIPAA). However, one or more of the Labs, Pharmacies, or Medical Groups (as defined in our Terms of Service) may be a "covered entity" or "business associate" under HIPAA, and HydraMed may be considered a "business associate" of a Pharmacy or Medical Group. HIPAA does not necessarily apply to an entity or person simply because health information is involved, and HIPAA may not apply to your transactions or communications with HydraMed, the Medical Groups, the Providers, the Labs, or the Pharmacies.

To the extent HydraMed is deemed a "business associate," and solely in that role, HydraMed may be subject to certain provisions of HIPAA with respect to "protected health information" (PHI) that you provide to HydraMed, the Medical Group, or the Providers. Any medical or health information you provide that is subject to specific protections under applicable state laws (collectively, with PHI, "Protected Information") will be used and disclosed only in accordance with such applicable laws. Protected Information does not include information that has been de-identified in accordance with applicable laws.

The Medical Groups and Providers have adopted a Notice of Privacy Practices that describes how they use and disclose Protected Information. By accessing or using any part of the Service, you are acknowledging receipt of the Notice of Privacy Practices from your Medical Group and Provider(s).

By accessing or using any part of the Service, you agree that even if HIPAA applies to HydraMed, the Medical Groups, the Providers, the Labs, or the Pharmacies, any information that you submit to HydraMed that is not intended and used solely for the provision of diagnosis and treatment by the Medical Group and Providers, laboratory services by the Labs, or prescription fulfillment by the Pharmacies, is not considered Protected Information and will only be subject to our Privacy Policy and any applicable state laws that govern the privacy and security of such information. For clarity, information you provide to HydraMed to register and set up an account on the Platform, including name, username, email address, shipping address, and phone number, is not considered Protected Information.

Additional Medical Information Collection

We also collect certain medical information on behalf of the Medical Groups and your Providers, which may include, but is not limited to:

  • Health and Medical Data: Information you submit for diagnosis or treatment purposes, including information in any questionnaires or surveys you complete for these purposes.

  • Visit Details: Dates of visits.

  • Diagnostic Media: Images or videos you share for diagnosis or treatment purposes.

  • Provider Communications: Communications with Providers.

We may also receive information about you from our partners. For example, as part of our identity verification process, our vendor may send us information they have independently collected, such as your name, age, and estimated location. Our marketing partners may also send us information about you, even if you have not visited or registered on our site.

Biometric Information

HydraMed does not collect or create biometric information about you. However, to use some of our services, we may be required to verify your identity. If you are asked to submit proof of identity (such as a driver’s license or passport), we may share that and the selfie you shared with us with our identity verification partner, who may create biometric information about your face to verify that your selfie matches your proof of identity. Biometric information is not shared with HydraMed and is deleted by our identity verification partner after completing the identity verification. HydraMed may receive information extracted from your photos, such as information from your driver’s license and the confidence that there is a “match” between your two photos. We use this information to help verify your identity.

  • Device Information: We collect technical data about your device, such as IP address, mobile device ID, browser type, operating system, connection speed, and hardware/software attributes.

This may include data from social media platforms, identity verification services, and marketing partners. For instance, as part of our identity verification process, our vendor may send us information they have independently collected, such as your name, age, and estimated location.

  • Forms from Third-Party Business Associates: We may also use forms provided by third-party business associates to collect your personal medical history, ensuring comprehensive healthcare service delivery.

  • Other Third-Party Sources: We may receive information about you from third parties that pay for your care or provide you with treatment, laboratory care, or prescription medication. This may include your prescription history and laboratory test results.

  • When HydraMed maintains the content or information on behalf of your Providers as part of your electronic medical record.

  • When the content or information is stored on or posted to the Site by a third party other than you, including any content or information posted by you that was stored, republished, or reposted by the third party.

  • When HydraMed anonymizes the content or information so that you cannot be individually identified.

  • When you do not follow the aforementioned instructions for requesting the removal of the content or information.

  • When you have received compensation or other consideration for providing the content or information.

The foregoing is a description of HydraMed's voluntary practices concerning the collection of personal information through the Service from certain minors and is not intended to be an admission that HydraMed is subject to the Children’s Online Privacy Protection Act (COPPA), the Federal Trade Commission’s Children’s Online Privacy Protection Rule(s), or any similar international, federal, state, or local laws, rules, or regulations.

This online payment processing application(s) is provided by HydraMed’s third-party online payment processing vendor, Electronic Merchant Systems (EMS). Additional information about EMS, its privacy policy, and its information security measures (collectively, the “EMS Policies”) can be found on the EMS website located at https://www.emscorporate.com/privacy-policy or by contacting EMS directly. Reference is made to the EMS Policies for informational purposes only and are in no way incorporated into or made a part of this Privacy Policy. HydraMed’s relationship with EMS is purely contractual in nature; EMS is a third-party vendor to HydraMed and is not subject to HydraMed’s direction or control. Therefore, their relationship should not be construed as one of fiduciaries, franchisors-franchisees, agents-principals, employers-employees, partners, joint venturers, or any other similar relationships.

Authorize.net

In addition to Electronic Merchant Systems, HydraMed also uses Authorize.net for payment processing services. Authorize.net is provided by Visa, and additional information about Authorize.net, its privacy policy, and its information security measures can be found on the Visa website located at https://usa.visa.com/legal/global-privacy-notice.html or by contacting Visa directly. Reference is made to Visa's privacy policy for informational purposes only and are in no way incorporated into or made a part of this Privacy Policy. HydraMed’s relationship with Authorize.net is purely contractual in nature; Authorize.net is a third-party vendor to HydraMed and is not subject to HydraMed’s direction or control. Therefore, their relationship should not be construed as one of fiduciaries, franchisors-franchisees, agents-principals, employers-employees, partners, joint venturers, or any other similar relationships.

Our website may contain links to affiliate and other websites. HydraMed is not responsible for the privacy practices of other websites. We encourage you to be aware when you leave our website and to read the privacy statements of each website that collects personally identifiable information.
